France Tightens Controls on Energy Savings Certificates to Combat Fraud and Ensure Compliance
France has enhanced regulatory controls on Energy Savings Certificates, enforcing stricter verification and risk management measures from November 2026 to fight fraud and ensure supplier compliance.
Key details
- Energy suppliers must comply with stricter rules for certificates issued after November 1, 2026.
- Acquirers must implement identification and risk management processes to detect fraud.
- Verification requires documentation including seller identity and internal procedures.
- Risk assessment covers eight categories, including insurance and compliance status.
France has reinforced the regulatory framework governing Energy Savings Certificates (CEE), imposing stricter verification and risk management requirements on energy suppliers trading these certificates starting November 1, 2026. Under the updated rules, energy suppliers must obtain CEEs by promoting and financing energy-saving projects to meet their targets, or face financial penalties.
The new regulations mandate that acquirers of CEEs implement robust identification and risk management procedures to detect fraudulent certificate transactions. They must document the verification process, including the seller’s identity and the internal protocols followed, with documentation that is dated and signed within twelve months before contract conclusion. Additionally, a supplementary form outlining the origin of transferred certificates must also be completed.
Risk evaluations must consider eight key categories, such as the existence of professional insurance, compliance with social and tax obligations, financial stability, and any sanctions related to CEE activities. Verification of capital ties between sellers, original certificate holders, and relevant control bodies is also required.
These measures aim to reinforce integrity in the CEE market and ensure that suppliers adhere fully to France’s energy saving goals, minimizing potential fraud and increasing transparency. The tightened controls signify a significant step in safeguarding the energy savings certificate system as France pursues its environmental commitments.
