Former Olympic swimming champion Yannick Agnel will be prosecuted for aggravated rape and sexual assault on a minor, following the rejection of his appeal by the Colmar Court of Appeal on January 15. The case involves allegations that Agnel engaged in a sexual relationship with Naomé Horter, the daughter of his former coach, when she was 13 years old in 2016, and Agnel was 23, living with her father at the time.

Despite Agnel's claims that the relationship was consensual and described as a simple 'amourette,' the court found sufficient evidence to proceed. The victim reported that the sexual acts were imposed repeatedly over six months and took place at various locations, including Mulhouse, Riedisheim, Thailand, and Spain. Agnel initially admitted to minor physical affection, later acknowledging a half-hearted attempt at penetration, but maintains he is neither a rapist nor a sexual predator, asserting he believed the victim could have said no due to her perceived maturity.

He faces potential penalties of up to twenty years in prison if convicted. The charges include aggravated rape and sexual assault on a minor under 15. Agnel has been cleared of related accusations involving another minor over 15. Currently, he remains under judicial control and presumed innocent under French law. His lawyer has five days to appeal to the Court of Cassation.

Prosecutor Edwige Roux-Morizot highlighted the significant age difference and moral coercion implied in the relationship. The legal process will continue in the Haut-Rhin criminal court, setting a serious precedent given Agnel’s public profile as a former sports icon.
